The number of foreign workers in Japan is increasing year by year. “Status of residence” that allows them to work in restaurants is necessary for them to work in Japanese restaurants. However, depending on status of residence, there are restrictions on working hours, and there are cases where you are basically not allowed to work at restaurants. What is the Status of Residence?

In the first place, the status of residence is a qualification required for foreigners to stay in Japan, and that is classified according to activities and status, such as “Students”, ”Skilled Labor”, “Spouse or Child of Japanese Nationals”, etc. Work permit and permitted activities are depending on status of residence, so there are some status of residence which are not allowed to work in restaurants.
If you work even though you are not authorized to work at a restaurant, you will be illegal worker and will be imposed penalties. So what are the statuses of residence to work at restaurants?


What is the status of residence to work in a Japanese restaurant?

There are various types of status of residence that allow you to work in Japan, but that you have a work permit does not necessarily mean you can work in a restaurant. In addition, the working range and working time may be limited.

■ Status of residence accompanying to your status

Foreigners with status of residence such as “permanent residents”, “Spouse or Child of Japanese Nationals”, “Spouse or Child of Permanent Resident”, “Long-term Resident”, etc. can work without restriction. Therefore, when working in a Japanese restaurant, you will be able to work in various fields such as customer service and cooking.

■Skilled Labor

Due to the status of residence that is granted to foreigners with skillful techniques, such as cooking local cuisine, serving customers mainly in the hall and Japanese cooking are not eligible. You can work as a cook who has a foreign origin to make Thai and French cuisine etc..

■ Specified Skilled Worker 1

A new status of residence established in April 2019 is given to foreigners with knowledge and experience in 14 specific industrial fields including the restaurant industry. Foreigners who have a specified skilled worker 1 of the restaurant business can engage in restaurant operations such as cooking, customer service, and store management.

■Designated Activities

It depends on each person’s permitted activities if you can work or not. You can check the instructions attached to your passport to confirm specific allowed activities . For example, “Japanese university graduates” that have been recognized since May 2019 are one of the designated activities. People who has the status can work at restaurants. At restaurants, they can serve as an interpreter, but you are not allowed to work for dishwashing or cleaning mainly.

■Permission for Other Activity

Foreigners with residence status of “Student” or “Dependent” are basically not allowed to work in Japan, but will be able to work by applying for and obtaining a “permission to engage in activities outside the scope of visa”. However, there is a condition of up to 28 hours working per week that does not interfere with the original activity scope. International students can work up to 8 hours a day and 40 hours a week only during long vacations.

Necessary conditions for obtaining status of residence

The necessary conditions to apply for status of residence is depending on status type. Here, we will briefly introduce the necessary conditions to apply for "Skilled Labor", "Specified Skilled Worker 1", "Designated Activities (Graduated from Japan University)", and "Permission for Other Activity".

■Skilled Labor

“Skilled Labor” is a status of residence given to foreigners with skilled techniques. Therefore, it is not easy to obtain. For foreign cooks, it is necessary to have at least 10 years of work experience (5 years for Thai food). The practical experience includes the period of studying at an educational institution.

■ Specified Skilled Worker 1

In order to obtain the Specified Skilled Worker 1 that permit to work at a restaurant, you need take some qualifications, “Skills Assessment Test for Food Service Industry” that measures the skill level and the Japanese Proficiency Test that measures the Japanese language skill level or the “Japanese Language Proficiency Test” (level N4 Or more). Also people who have completed the second technical training in the restaurant industry are intended.

■Designated Activities(graduates of Japanese universities)

This is a status of residence that requires a high degree of Japanese ability and an educational background that has graduated from a Japanese university or graduate school. Specifically, high Japanese language ability means a person who has passed the Japanese Language Proficiency Test (N1) or who has a BJT Business Japanese Language Proficiency Test of score 480 or more. This also applies to people whose major at the university or graduate school is “Japanese”.

■Permission for Other Activity

If you who has a status of residence that does not have a work permit, such as “Student”,want to work in a restaurant, you must apply for a “Permission to Engage in Activity other than that Permitted under the Status of Residence Previously Granted” in advance. Please note that you are not allowed to work while applying for permission. If you are a foreigner who wants to work in a restaurant, first check your status of residence and the range of work allowed. Again, if you are not allowed to work with your status of residence or you work outside the scope of your activity, it will be "illegal work".

Foreign job seekers who are not currently allowed to work should apply for an “Permission to Engage in Activity other than that Permitted under the Status of Residence Previously Granted” or change to a resident status which working is permitted before working at a restaurant.
